Valid Grounds for Divorce in
District of Columbia
According to the latest reports from the US Centers for Disease Control and Prevention, the District of Columbia divorce rate in 2019 was 2.4 per 1,000 residents. From 2015 to 2019, the divorce rate in DC dropped by 0.4%.
Washington DC allows spouses to obtain only a no-fault divorce. It means that the court does not require the petitioner to provide proof of the spouse's misconduct. Alcoholism, adultery, or impotence are not reasons for divorce.
There are two legally accepted reasons for no-fault divorce in the District of Columbia:
•both spouses have lived separately and apart voluntarily without cohabitation for at least six months before filing for divorce;
•both spouses have lived separately and apart without cohabitation for at least 12 months if one of the spouses disagrees with the divorce and separation.
